Description: Major developments between January 2013 and September 2014 include:
- in 2013, the European Commission presented a new port policy vision including a proposal for a Regulation on market access to port services and financial transparency of ports which does not deal with labour-related matters however;
- also in 2013, the social partners, with the assistance of the European Commission,launched a formal social dialogue process which will look into, inter alia, training,certification, health and safety, but not labour market issues;
- at the international and EU level, the automation of shipping and port operations is attracting increasing attention and can be considered a major issue for the immediate future;
- in the broader context of economic reform and under the supervision of the IMF, the ECB and the European Commission, Greece and Portugal recently introduced substantially modernised laws and regulations on port labour;
- the European Commission has undertaken formal infringement procedures against Spain and Belgium, with the latter Member State standing out as the only one in the EU where port labour never underwent any fundamental reform;
- Member States were further reform measures were introduced or prepared include Bulgaria and France;
- require market access for temporary work agencies unless a thorough and treaty-compliant justification is effectively submitted;
- where necessary, launch infringement procedures or impose reform in the context of other EU policies before resorting to new legislative initiatives;
- in a first step, leave the elaboration of a certification and qualifications framework as well the implementation of the principle of mutual recognition to the forthcoming social dialogue;
- investigate the possibility of legally obliging Member States to maintain specific OHS statistics on port labour;
- monitor compliance by Member States with existing EU requirements in relation to safety training by temporary work agencies and enforcement of OHS rules by national labour inspectorates.
