With the entry into force of the 2010 Manila amendments to the STCW Convention and the 2006 Maritime Labour Convention (MLC 2006), it is expected that Port State Control procedures will pay increasing attention to ensuring compliance with the requirements. There is a risk that variations in interpretation of the regulations by Port States will increase the likelihood of deficiencies being reported and/or vessels being detained.
The main changes in the STCW have the effect of aligning it with the MLC convention to avoid any conflict. The STCW convention for the work & rest hours has been in force since the 1st of Jan 2012. Members might need to check the revised conditions for exceptions that might require any changes in their company SMS.
This information highlights areas of concern with regard to potential ambiguities and differing interpretations of the Conventions' requirements. The papers considers minimum expectations to ensure compliance with related provisions and recommendations are provided for the information of the managers and crews of applicable vessels.
